Terms and conditions

For apartment bookings made directly on happystay.at. This English version is a translation; the German version is authoritative.

1. Scope and contracting party

These terms apply to contracts for accommodation in our apartments that you book directly on happystay.at. If you book through a platform such as Booking.com or Airbnb, the terms and cancellation policy shown to you there apply.

Your contracting party is HappyStay GmbH, Alliiertenstraße 1/28, 1020 Wien, Austria, company register number FN 581562p (“we”). You can reach us by email at hello@chat.happystay.at or by phone and WhatsApp at +43 670 3086377.

Anything we expressly agree with you individually takes precedence over these terms.

2. Booking and conclusion of the contract

Booking takes four steps:

  • choose your dates and number of guests,
  • check the apartment and extras,
  • enter your contact details,
  • choose a payment method and click “Book with obligation to pay”.

Before the final click you see all your details and the total price. Use “Back” to change any of them. Only the click on the final button is your binding offer. The contract is concluded as soon as we confirm your booking. We send you the confirmation by email with a link to these terms.

We store your booking details. You can find these terms at any time at happystay.at/en/agb, where you can save or print them.

You can conclude the contract in German or in English. The English version of these terms is a translation. If the two versions differ, the German version applies.

3. Prices and city tax

All prices are in euros and include VAT. The total price consists of the price of your stay (the nights including final cleaning), any extras you book and the city tax. Each part is listed separately before you book.

The city tax is a statutory levy of the city or the federal state. We collect it and pay it over.

4. Payment

You pay the total price when you book, using one of the payment methods shown (for example credit card, Apple Pay or Google Pay). Payments are processed by our payment provider Stripe. We first place a hold on your card for the amount and charge it as soon as the apartment is reserved for you. If the apartment cannot be reserved, we release the hold.

5. Cancellation by you

Important: for accommodation on fixed dates you have no statutory right of withdrawal (Section 18(1)(10) Austrian Distance and Off-Premises Contracts Act). You can, however, cancel under the following rules:

  • Up to and including 14 days before the day of arrival: free of charge. You get the full amount back.
  • From 13 up to and including 7 days before the day of arrival: we keep 50% of the price of your stay.
  • From 6 days before the day of arrival, or if you do not arrive: we keep the full price of your stay.

What counts is when your cancellation reaches us (Vienna time, until 11:59 pm on the day in question). Please cancel by email or WhatsApp. If you book less than 14 days before arrival, the schedule applies from the day of booking.

You always get any extras and the city tax back, because they are not incurred without a stay.

If we let the apartment to other guests for the cancelled nights, we credit that income. We also credit anything else we save because of your cancellation. We refund you that amount.

We pay refunds within 14 days to the payment method you used. You can protect yourself against cancellation costs with travel cancellation insurance.

6. If we cannot provide the apartment

If the apartment you booked becomes unusable (for example after water damage), we offer you an equivalent apartment if this is reasonable for you. We bear any additional costs. If you do not accept the alternative or we have none, you get the full amount back. Any further statutory claims remain unaffected.

7. Arrival, stay and departure

Arrival and departure times are shown on the apartment page and in your booking confirmation. We send you the self check-in instructions before you arrive.

No more people may stay overnight in the apartment than you booked for.

The Austrian Registration Act (Meldegesetz) requires us to keep a guest register. Please give us the required details for all guests before or on arrival.

8. House rules

Please treat the apartment and its furnishings with care and be considerate of the neighbours. The house rules shown on the apartment page and in the apartment apply, as do the rules of the building. Please report any damage to us as soon as possible.

In the event of serious breaches we may terminate the contract with immediate effect, for example in the case of a party, considerable disturbance of the neighbours or if significantly more people stay overnight than booked. In that case we keep the price for the booked nights, but we credit anything we save as a result or earn by letting the apartment again.

9. Liability

We are liable in accordance with the statutory provisions.

For items you bring into the apartment, we are liable in accordance with Sections 970 et seq. of the Austrian Civil Code (ABGB).

You are liable in accordance with the statutory provisions for any damage caused by you or the people travelling with you.

If you book as a business, we are liable for damage to property only in the event of intent or gross negligence.

10. Data protection

11. Applicable law and place of jurisdiction

Austrian law applies. Mandatory consumer protection provisions of the country where you are habitually resident remain unaffected.

For consumers, the statutory places of jurisdiction apply. If you book as a business, the court with subject-matter jurisdiction for 1020 Vienna has jurisdiction.

12. Final provisions

The version of these terms published on happystay.at at the time of your booking applies.

If any clause is invalid, the remaining clauses remain valid.
